Growth blocking access to KCC Lamp Columns

Hi all, I am a highway steward from KCC, our street lighting team have requested that you cut back the vegetation around columns BHAG006 BHAG007 BHAG008, which land reg confirms are on NH land, so we can access the columns for testing and maintenance. They have said this is urgent. Thank you! I'd be really grateful for a quick email update with a timescale, so I can update them.

    Thank you for your report.

    I appreciate you bringing your concerns about the overgrown vegetation at the Brewers Road roundabout, near the A2 on the London-bound side, to our attention. I understand your request for National Highways to undertake the necessary maintenance. However, while we acknowledge your concerns, responsibility for maintaining Public Rights of Way rests with the relevant highway authority, regardless of ownership of the trees themselves. The is location is outside our maintainable boundary.

    The plot of land located at the location highlighted forms part of the Local Highway Authority's (LHA) network and is maintainable at public expense. This land was acquired as part of a Side Roads Order, and National Highways is recorded as holding title under references TT6212 and K818087.

    However, under the provisions of Section 14 of the Highways Act 1980, land acquired through a Side Roads Order transfers to the Local Highway Authority. While National Highways retains ownership of the subsoil, responsibility for maintenance and the surface layer (the zone of ordinary use) is vested in the LHA. Furthermore, the fact that the lighting columns are owned by the Council confirms that it’s responsible for the road and the adjoining verges.

    Consequently, any work required to cut back vegetation that is encroaching onto the footpaths falls within the responsibility of the Local Highway Authority rather than National Highways.

    We appreciate that this may not be the outcome you were hoping for and apologise that we are unable to assist further on this occasion.
