Overhanging trees from the A40 highway verge are extending significantly past my property boundary line into my garden. The overhanging branches are causing a continuous sanitary nuisance due to a heavy accumulation of bird droppings on my private property. Location is adjacent to the A40.

The trees situated on the A40 highway verge have grown unmaintained and are now encroaching significantly past the boundary line into my private garden. Because these substantial branches are overhanging my property, large numbers of birds are constantly roosting directly above my garden. This has created a severe and continuous sanitary nuisance, as bird droppings are heavily coating the garden area below. This is causing ongoing mess, property damage, and a health hazard on my private land. The vegetation needs to be pruned back to the National Highways boundary line to resolve this encroachment and ongoing property nuisance.

We only take action when a tree causes a legal nuisance to neighbouring properties. This means a nuisance that is actionable in law. For example, when trees are actually touching buildings and causing direct damage. We also don't prune: • to improve television or internet signals, or how solar panels work • to prevent nuisance from pests (for example greenfly), falling fruit, pollen or bird droppings • to allow the construction of new entrances or driveways You’re within your common law rights to prune back trees that overhang the boundary fence into your garden. Our Arboriculturist will visit the site to ensure there are no other factors involved that may require intervention on our part.
