Signage attached to railings.

I am formally requesting the removal of flags currently attached to the railings of the motorway overpass where Southworth Lane passes over the M6. These installations constitute an unlawful obstruction under the Highways Act 1980, Section 137, and fall within the scope of Section 149, which empowers the highway authority to remove items that present a danger on the highway. They also contravene the Traffic Signs Regulations and General Directions 2016, as unapproved signage or visual distractions can endanger motorists. Furthermore, the flags pose a structural and safety risk, as railings are not designed to bear additional loads, and there is a clear risk of debris falling onto live carriageways. This presents a foreseeable danger and conflicts with the duty under the Health and Safety at Work etc. Act 1974, Regulation 3(1), to ensure risks to the public are reasonably controlled. I therefore request that National Highways arrange for their prompt removal in order to uphold statutory obligations and protect road user safety.

  • Thank you for your report. We will inspect the location. Currently, our approach is to leave the flags in place unless they are offensive or cause a hazard. We’ll continue to monitor this and remove the flags when appropriate.
