3 overgrown trees with branches coming over my fence

There are three trees on my boundary at 50 Fitzalan Road. They are very close to my fence and branches from two of the trees are now over my fence. In fact I see a branch has come down and leaning against the fence. Whilst I’m worried firstly about the roots going under my Driveway and garage, they are now causing a serious blockage of light. I’m having a garden room built at the bottom of my garden and I’m worried about the branches overhanging and dropping sap as well as the blocking of lights.

Thank you for your report about the condition of 3 trees close to your property 50 Fitzalan Road, Arundel.
While the title register confirms that National Highways is registered as the title holder to the land in question, our interest in the land is in the subsoil.
The land was acquired for the Folkestone-Honiton Trunk Road Proposed Arundel Relief Road scheme in the 1970's.
However under the terms of the Folkestone-Honiton Trunk Road (Arundel Relief Side Roads) Order 1971 any new highways, created or improved by the side roads order, becomes the responsibility of the Local Highway Authority as it was vested to them by virtue of Section 14 of the Highways Act 1980.
The surface of the road, and the land surrounding it is part of the land that the side roads order has vested over to the Local Highways Authority.
Based on this evidence, the land that you have identified should be maintained by West Sussex County Council as Local Highways Authority. This will include any vegetation that is growing on the land.
