Vegetation clearance during nesting bird season

Kier Vegetation crew were flailing vegetation using a tractor flail 12/04/22. There is no way to ensure nesting birds are not harmed if vegetation is cleared using a flail. Vegetation legally requires ecological supervision if undertaken inside nesting bird season 1st march - end august inc.

I had the report the same issue last year as this is the second year running this will be reported to Natural England as this is a clear legislative breach.

  • Thank you for contacting National Highways concerning bird nesting in cleared vegetation.

    I can assure you that we do not undergo vegetation clearance until a thorough inspection has been carried out of all directly affected trees/hedges and those in immediate proximity to the works. If nesting birds are discovered, work must be put on hold and rescheduled for later in the year. These checks are carried out during nesting season from early March to late September. According to Kier's Method Statement, these works would not have taken place without a thorough assessment of the area beforehand.
